G. SELVAKUMAR vs STATE OF TAMIL NADU,

FACTS
In this case FIR was Registered over allegation of criminal breach of trust, cheating etc. and an
intermittent bail was granted over the condition that he will settle the dispute relating to the
human payment of money. Later accused told that court he is facing difficulty to pay the Money
due to some domestic circumstances. The High Court didn't appreciate the response and thus
dismissed the bail stating, " If he knows that he would not be in the position to make any
payment he should've prayed for grant of regular bail" Challenging this the accused filed a SLP
before the supreme court.
JUDGEMENT
The Supreme court observed that, " The court can't refuse to hear a bail application in the ground
the accused failed to comply with the settlement offer made.”
